The court ruled that Independent Electoral and Boundaries Commission acted unreasonably to disqualify Sonko from vying for Mombasa gubernatorial seat.
“They violated the Constitution and rushed with the announcement,” the court said.
The Wiper man took IEBC to court for disqualifying him from the Mombasa race due to a gross violation of Article 75 of the Constitution. This led to his ousting as the city boss.
He then moved to court to stop the Wiper Party from submitting the names of other candidates and at the same time stop IEBC from gazetting and printing the ballots for the Mombasa governor race, until his fate is known.
His call was accepted following the three-judge bench issuing of his orders against IEBC to stop gazettement and printing of ballot papers.
